Terms of Service

Effective date: October 1, 2026

These Terms of Service (“Terms”) apply when you use cuysdigital.com or hire CuysDigital (“we,” “us,” or “our”) for any service. By booking a project, paying an invoice, or using our website, you agree to these Terms. If a signed proposal or agreement says something different, that document takes priority for that project.

1. Our services

We provide website design and development, SEO, website maintenance, branding and graphic design, social media management, video editing, CRM and automation setup, and related digital services. The exact scope, deliverables, timeline, and price for each project are listed in your quote or proposal. Work outside that scope is treated as a change request and may cost extra.

2. Quotes and proposals

Quotes are valid for 30 days unless stated otherwise. Prices on our website are starting prices. Your final price depends on your project’s scope.

3. Payment terms

  • One-time projects: 50% upfront before work starts, and the remaining 50% before launch or final file delivery.
  • Monthly plans: billed in advance at the start of each billing period.
  • Late payments: if an invoice is unpaid 7 days after its due date, we may pause work until it is paid.
  • Third-party costs: prices do not include hosting, domains, premium plugins or themes, stock assets, software subscriptions (such as GoHighLevel or Zoho), or ad spend, unless stated in your quote.
  • Currency and fees: you pay in the currency on your invoice. Bank or transfer fees are the client’s responsibility.

4. Timelines

Project timelines are estimates and depend on you providing content, feedback, and approvals on time. If a project is paused for more than 30 days because we are waiting on you, we may need to reschedule it and may charge a restart fee.

5. Revisions

Each package includes the number of revision rounds stated in your quote. Additional revisions, or changes after approval, are billed separately at our current rate.

6. Your responsibilities

You agree to:

  • Provide accurate content, information, and timely feedback
  • Make sure you have the rights to any text, images, logos, or materials you give us
  • Give us the access we need, such as logins to your website, hosting, or CRM
  • Review and approve work before launch

You are responsible for the content on your website and for following the laws that apply to your business.

7. Ownership and intellectual property

  • Once we receive full payment, you own the final deliverables created for you, such as your website design, logo, and graphics.
  • We keep ownership of our pre-existing tools, code, templates, and processes, and grant you a license to use them as part of your project.
  • Third-party items such as themes, plugins, fonts, and stock images stay under their own licenses.
  • Until full payment is received, all work remains our property.
  • We may show completed work in our portfolio and marketing, unless you ask us in writing not to.

8. Confidentiality

We keep your business information, login details, and customer data confidential. We only use them to deliver your project. See our Privacy Policy for more details.

9. Hosting, domains, and third-party services

We may set up or recommend third-party services such as hosting, domains, email, and software. We are not responsible for their outages, price changes, policy changes, or data loss. Where possible, domains and accounts are registered in your name so you stay in control.

10. Monthly plans and cancellation

You can cancel a monthly plan with 30 days written notice. Payments already made for the current period are not refundable, and services continue until the end of that period.

11. Refunds and project cancellation

  • The upfront payment is non-refundable once work has started.
  • If you cancel a project, you pay for the work completed up to the cancellation date.
  • If we cancel a project, we refund any payment for work not yet delivered.

12. No guaranteed results

We work hard to help your business grow, but we cannot guarantee specific search rankings, traffic, leads, followers, or sales. These depend on many factors outside our control.

13. Limitation of liability

To the extent allowed by law, we are not liable for indirect or consequential losses, such as lost profits, lost data, or business interruption. Our total liability for any claim is limited to the amount you paid us for the specific service in the 3 months before the claim.

14. Termination

Either party may end a project if the other party seriously breaches these Terms and does not fix the issue within 14 days of written notice.

15. Use of our website

All content on cuysdigital.com, including text, graphics, and logos, belongs to CuysDigital unless stated otherwise. You may not copy or reuse it without permission, or use the website for any unlawful purpose.

16. Governing law

These Terms are governed by the laws of the Republic of the Philippines. Any disputes will be handled by the proper courts of Olongapo City, unless the law requires otherwise.

17. Changes to these Terms

We may update these Terms from time to time. The latest version will always be on this page. Active projects continue under the Terms in place when they started, unless both parties agree otherwise.
